Thank you for your letter concerning the alleged unlicensed use of an image attributed to Epa Images, reference number 1623-7777-5085. We appreciate you bringing this to our attention and are keen to resolve it constructively and in good faith.
Before we can properly consider your claim, we would be grateful if you could provide:
1. Proof of representation and title – documentary evidence that PicRights is authorised to act on behalf of the rights holder, and that valid copyright subsists in the image.
2. Basis for the sum claimed – a breakdown of the £650.00, including the standard licence fee, any administrative or enforcement costs, and the basis on which these are recoverable. We have not been able to locate a published tariff for comparable use, so your help in explaining the calculation would be appreciated.
3. Circumstances we hope you will kindly take into account
< >The image was used by a registered charity and religious non-profit organisation, solely for religious and pastoral purposes, with no commercial gain whatsoever.The use was entirely inadvertent; we were unaware a licence was required.The moment we became aware of the issue, we removed the image from our website immediately, without hesitation, delay, or the need for any further prompting. We acted simply because it was the right thing to do.any settlement reflects the actual licence value that would ordinarily have applied, taking into account the charitable, non-commercial nature of the use and our immediate corrective action; andany settlement is confirmed in writing as full and final, with no further liability or correspondence.Thank you in advance for your understanding and kind reconsideration of this matter.
